Terms of Use
Draft of 16 July 2026 · Not in force
Written from how the service actually behaves in code, not by a lawyer. Items marked LIKE THIS must be settled before publication. Norwegian consumer law is mandatory: terms that strip a consumer of rights are void regardless of what this says.
1. Who this agreement is with
Taptober is provided by COMPANY NAME, company number REG. NUMBER, POSTAL ADDRESS ("we", "us").
By creating an account you accept these terms. They apply whether or not you read them — but we have tried to keep them short and readable.
2. What Taptober is
Taptober is an app tied to Oktoberfest festivals. You answer quizzes, log weekly activity, compete on leaderboards, challenge friends, and can claim prizes from festival sponsors.
Taptober does not sell alcohol and does not encourage drinking. The service does not record what or how much you drink. "Streaks" are a tap on an activity button, and collectable badges are unlocked by quizzes and activity.
3. Account and age limit
You must be at least 18 to use Taptober. We ask for your date of birth during onboarding, and accounts below the age limit are not created.
Your date of birth cannot be changed once set. That is deliberate: an age limit you can walk past by declaring a new birthday is not an age limit. If you entered the wrong date, contact us at EMAIL.
You are responsible for keeping your password secret and for activity on your account. One person, one account.
4. Rules of use
You must not:
- create multiple accounts to gain an advantage,
- use bots, scripts or automation against the service,
- try to circumvent the age limit or the geographic block,
- upload content that is illegal, hateful, threatening, or infringes others' rights,
- impersonate anyone,
- attempt to breach, overload or probe our systems.
If you find a security weakness, report it to EMAIL before sharing it. We will not pursue anyone who reports in good faith and gives us reasonable time to fix it.
5. Points, leaderboards and cheating
Points are always calculated on our server from your answers and speed. Points have no monetary value, cannot be exchanged, sold or transferred, and may be adjusted or reset if awarded in error or through cheating.
Your username and rank are shown publicly on leaderboards. That is the entire point of a leaderboard — choose your username accordingly.
If we suspect cheating we may investigate and adjust points. RESOLVE: the code contains an automatic ban that is currently not wired up. If it is switched on, these terms must describe it — and it must have human review, or it breaches GDPR Art. 22.
6. Prizes and competitions
- Prizes are skill-based — decided by quiz results and rank, not by chance. Taptober is not a lottery.
- Prizes come from festival sponsors. Quantities are limited and stated with the prize.
- Age-restricted prizes require you to meet the age limit in your country (18, or 21 in the USA).
- To receive a prize you must provide your name, email and address. We use this only to send the prize — see the privacy policy.
- Prizes cannot be exchanged for cash.
- RESOLVE: who is liable if a sponsor fails to ship a prize — Taptober or the sponsor? Against a Norwegian consumer, whoever appears responsible generally is. Settle this in the sponsor contracts, not only here.
- RESOLVE: deadline for claiming a prize, and what happens to unclaimed prizes.
7. Premium and payment
Premium is an optional subscription. Payment is handled by Stripe; we never receive your card number.
Right of withdrawal: as a consumer you have 14 days to withdraw under the Norwegian Right of Withdrawal Act. If you start using Premium within that period you consent to delivery beginning, and the right lapses once the service has been delivered in full.
The subscription renews automatically until you cancel. You may cancel at any time and keep Premium for the period you have paid for. RESOLVE: price, period and any trial are not set in the code.
8. Your content
Content you enter — username, display name, avatar, bio — is yours. You grant us a limited, non-exclusive right to display it within the service, for example on leaderboards and in the friend feed. That right ends when you delete the content or your account.
We may remove content that breaches section 4.
9. Festivals and organisers
When you join a festival with a festival ID, the organiser can see your username, points and activity within their festival, and can send you notifications.
The organiser is responsible for their own festival, events and prizes. We provide the platform.
10. Termination and suspension
You can delete your account at any time in the app. We then delete your data as described in the privacy policy. DEPENDS ON UNSHIPPED CODE — deletion does not exist in the API as of 16 July 2026.
We may close an account for a material breach of section 4. For less serious breaches we will warn you first. If we close your account wrongly, you get it back.
11. Liability
Taptober is provided "as is". We do not promise it is error-free or always available — it is a festival app, not a critical service.
We remain liable for loss caused by our negligence to the extent mandatory Norwegian law requires. Nothing in these terms limits your rights as a consumer. Any disclaimer that conflicts with mandatory consumer protection does not apply.
12. Changes to these terms
If we change these terms materially we will notify you in the app or by email at least 30 days before the change takes effect. If you disagree, you can close your account. Continued use after the change takes effect counts as acceptance.
13. Governing law and disputes
Norwegian law applies. RESOLVE: venue depends on which company stands behind this — if the company is foreign, a Norwegian consumer can sue in Norway anyway under the Lugano Convention, and a choice-of-law clause cannot deprive a consumer of the protection of their home country.
If you disagree with us, contact EMAIL first. If we cannot agree, you may complain to the Norwegian Consumer Authority or the Consumer Disputes Committee (forbrukertilsynet.no), or use the EU online dispute resolution platform.
